Two different roles

For agency account data (name, email, billing, service usage) we are the data controller.

For the data on clients, owners and documents that each agency enters, the agency is the controller and we act as its processor (art. 28 GDPR) under the data processing agreement included in the Terms.

If you are a client of an agency

If an agency has sent you a link to its portal, asked you to sign or sends you appointment reminders through Immofolder, that agency decides which of your data is processed and why. To exercise your rights, contact the agency first; if you write to us, we will pass your request on.

When you sign a document we keep, on the agency's behalf, the signature evidence: your name, email, drawn signature, date and time, IP address and browser. It is used to prove that the signature is yours.

What agency data we process and why

Account and team data (name, email, language) to provide the contracted service (performance of contract).

Billing data, through Stripe, to charge the subscription and meet tax and accounting obligations (contract and legal obligation).

Service emails: invitations, password recovery, signing codes, trial-end and payment notices, and the daily appointment summary (performance of contract).

Technical security data: IP address and email on sign-in attempts (to stop attacks, deleted within a day) and application error logs (to fix bugs). Legal basis: legitimate interest in keeping the service secure.

We do not sell data or use it for advertising. We do not use agency or client data to train AI models.

Providers (sub-processors)

Supabase Inc.: database, file storage and user access. EU servers (Frankfurt, Germany).

Render Services, Inc.: application hosting. EU servers (Frankfurt, Germany).

Anthropic PBC: AI that reads documents and texts. Under its commercial terms it does not use the data to train its models and only keeps it for a limited time.

Stripe Payments Europe Ltd.: payment of subscriptions and packs.

Sendinblue SAS (Brevo): delivery of service emails.

International transfers

Data is stored in the EU. Some providers are based in the US and may access it; in that case the EU-US Data Privacy Framework or the European Commission's standard contractual clauses apply.

Retention

For as long as the account is active. The agency owner can download all data and delete the account at any time from Settings: deletion is immediate and backups are gone within 30 days at most.

If the trial or subscription ends without renewal, we keep the account for 12 months in case the agency comes back, and then delete it. Invoices are kept for the period required by law (6 years).

E-signature evidence is kept with the signed document for as long as the agency keeps it.

Your rights

You can exercise access, rectification, erasure, objection, restriction and portability by writing to hola@immofolder.com. You can also complain to your data protection authority (in Spain, www.aepd.es).
